Terms Of Use

By accessing “Hardy Tropicals UK” (hereinafter “we”, “us”, “our”, “Hardy Tropicals UK”, “http://www.hardytropicals.co.uk/forum”), you agree to be legally bound by the following terms. If you do not agree to be legally bound by all of the following terms then please do not access and/or use “Hardy Tropicals UK”. We may change these at any time and we’ll do our utmost in informing you, though it would be prudent to review this regularly yourself as your continued usage of “Hardy Tropicals UK” after changes mean you agree to be legally bound by these terms as they are updated and/or amended.

Our forums are powered by phpBB (hereinafter “they”, “them”, “their”, “phpBB software”, “www.phpbb.com”, “phpBB Group”, “phpBB Teams”) which is a bulletin board solution released under the “General Public License” (hereinafter “GPL”) and can be downloaded from www.phpbb.com. The phpBB software only facilitates internet based discussions, the phpBB Group are not responsible for what we allow and/or disallow as permissible content and/or conduct. You agree not to post any abusive, obscene, vulgar, slanderous, hateful, threatening, sexually-orientated or any other material that may violate any laws be it of your country, the country where “Hardy Tropicals UK” is hosted or International Law. Doing so may lead to you being immediately and permanently banned, with notification of your Internet Service Provider if deemed required by us. The IP address of all posts are recorded to aid in enforcing these conditions. You agree that “Hardy Tropicals UK” have the right to remove, edit, move or close any topic at any time should we see fit. As a user you agree to any information you have entered to being stored in a database. While this information will not be disclosed to any third party without your consent, neither “Hardy Tropicals UK” nor phpBB shall be held responsible for any hacking attempt that may lead to the data being compromised.

Privacy Policy

Your information is collected via two ways. Firstly, by browsing “Hardy Tropicals UK” will cause the phpBB software to create a number of cookies, which are small text files that are downloaded on to your computer’s web browser temporary files. The first two cookies just contain a user identifier (hereinafter “user-id”) and an anonymous session identifier (hereinafter “session-id”), automatically assigned to you by the phpBB software. A third cookie will be created once you have browsed topics within “Hardy Tropicals UK” and is used to store which topics have been read, thereby improving your user experience.

We may also create cookies external to the phpBB software whilst browsing “Hardy Tropicals UK”, though these are outside the scope of this document which is intended to only cover the pages created by the phpBB software. The second way in which we collect your information is by what you submit to us. This can be, and is not limited to: posting as an anonymous user (hereinafter “anonymous posts”), registering on “Hardy Tropicals UK” (hereinafter “your account”) and posts submitted by you after registration and whilst logged in (hereinafter “your posts”).

Your account will at a bare minimum contain a uniquely identifiable name (hereinafter “your user name”), a personal password used for logging into your account (hereinafter “your password”) and a personal, valid e-mail address (hereinafter “your e-mail”). Your information for your account at “Hardy Tropicals UK” is protected by data-protection laws applicable in the country that hosts us. Any information beyond your user name, your password, and your e-mail address required by “Hardy Tropicals UK” during the registration process is either mandatory or optional, at the discretion of “Hardy Tropicals UK”. In all cases, you have the option of what information in your account is publicly displayed. Furthermore, within your account, you have the option to opt-in or opt-out of automatically generated e-mails from the phpBB software.

Your password is ciphered (a one-way hash) so that it is secure. However, it is recommended that you do not reuse the same password across a number of different websites. Your password is the means of accessing your account at “Hardy Tropicals UK”, so please guard it carefully and under no circumstance will anyone affiliated with “Hardy Tropicals UK”, phpBB or another 3rd party, legitimately ask you for your password. Should you forget your password for your account, you can use the “I forgot my password” feature. This process will ask you to submit your e-mail, then the software will send an e-mail containing information about changing your password.

Any user uploading images to the site must have the copyright owners permission before the image is uploaded. Any Images uploaded to the site will still remain the property of the image owner but you agree to give Hardy Tropicals authorisation to display the images for the lifetime of the forum.

We have the right to investigate any user deemed to be abusing or misusing this site without prior warning.

Please be polite, and remember everyone has the right to have a differing opinion :-) If posts consist of just smilies they will be removed when seen by moderators as they contribute nothing to the contect of the topic.

New and non active members may not have full functionality in keeping with our anti spam and nusience policy. These members might not be able to use the PM and email facility until they actively start posting. Also any member who ceases to post for a period of time may become 'non-active' and be subject to similar restrictions.

Posts - If you feel that a post is inappropriate in some way there is the option to report it by clicking this image below each post (Image) which will mean that the moderators will be alerted to that post. This may result in the post being edited/removed. i would ask that you do not respond to these posts individually but continue to post on that thread. All posts should try to remain on topic and not change the direction unessesarily. This rule does not apply to the Off topic section of the site. Any messages which breach the rules may/will be removed without warning.

Post Spelling - Here on HTUK we don't mind bad spelling (we're not going to kick you out :D ), but if you make some minor errors your posts may be edited by moderators to correct them. To make things easier there is now a spell checker please check out this link.

Personal Messages - If you receive a Personal Message from someone that is inappropriate or of an offensive nature and you wish to report it do not delete it, as it will be permanently deleted, send me a PM telling me about the abusive PM and their username. I can then look at the PM and take appropriate action. To make these messages available to members they are stored in a database which allows them to be accessed from your account. If contacted by either a sender or recipient of a message or if asked to, due to suspicion of illegal activity, they may be looked at to access the content of the message and take appropriate action if necessary. Messages are not automatically screened for content and are the responsibility of the sender. I would not advise using Personal Messages for sensitive personal or financial information as the messages travel unencrypted between your computer and our server and is not encrypted in this database. Anyone reported as misusing this facility will be investigated and we reserve the right to remove the service.

Photo Attachments - These are a great way to share photo's of your garden and other things but anything that is offensive or inappropriate may be removed without warning.

Any messages i receive about inappropriate use of the forum will be looked into.

Punishment - if i find that the PM or post is of an offensive or inappropriate nature you will be on a 5 strikes and you're out system.

* 1st strike - Warning Via PM.
* 2nd strike - banned from the forum for 24 hours.
* 3rd strike - banned from the forum for 1 week.
* 4th strike - banned from the forum for 1 month.
* 5th strike - banned permanently, IP, username and e-mail.


This system is at the discretion of the moderators and administrators. If at any point you feel something has been removed or edited out and do not know why, please PM (rather than post a message) either a member of the moderators or Admin Team.

Selling/Swapping Plants

The selling and swapping of plants is not something for the main forum. But members swapping/selling plants occasionally should use the Swaps and freebies forum located here. If you are a more serious plant seller then you may like to have your own sub-forum, with moderator privileges, which allows you to administer your own selling. This at the current time is visable to members only. If you are interested in having your own sub-forum please PM Site Admin.
